Terms of sale
These terms govern every order placed through this shop. They are written to be read, not to be survived.

1. Who you are buying from
This shop is operated by Evgeni Karb, trading as Darkpact Tokens, Bertrand-Russell-Allee 8, 18147 Rostock, Germany. Full contact and tax details are on the legal notice.
These terms apply in the version current at the time of your order. We do not accept conflicting terms supplied by a buyer unless we have agreed to them in writing.
2. What you are buying
Printed art cards at standard card size (63 x 88 mm), sold as single cards rather than sets. They are collectibles and play aids.
They are not tournament-legal Magic: The Gathering cards and may not be used in place of real cards in sanctioned play. Whether they are welcome in a casual game is between you and your table.
Screens vary, and foil is difficult to photograph. Colour and the behaviour of the foil in the product images are an approximation of the printed card, not an exact match.
3. Not affiliated with Wizards of the Coast
Darkpact Tokens is an independent, unofficial, fan-made project. It is not produced by, licensed by, endorsed by, or affiliated with Wizards of the Coast LLC. Magic: The Gathering is a trademark of Wizards of the Coast LLC. All artwork sold here is original work created for Darkpact Tokens and is not reproduced from any published card.
4. How the contract is formed
The product pages are an invitation to order, not a binding offer. You make a binding offer when you complete payment at checkout. The contract comes into effect when we accept that offer by sending you an order confirmation by email.
If a card turns out to be unavailable after you have paid, for example because a run sold out in the seconds between two orders, we will tell you and refund that item in full. No contract is formed for an item we cannot supply.
The contract is concluded in English. We store the order data and send you the details by email; there is no separate contract text you can retrieve from an account on this site.
5. Prices and VAT
All prices are in euro and include statutory VAT. Shipping is added on top and is shown in full, with the total, before you enter any payment details. There are no fees added after that point.
Prices for orders outside the EU may exclude German VAT where the export rules require it; the price you are shown at checkout is the price you pay us. Import duty and local tax in the destination country are separate and are yours, as set out under customs.
6. Payment
Payment is processed by Stripe Payments Europe, Ltd. The payment methods available to you depend on your country and are shown at checkout. Payment is due in full when you place the order.
Card details are entered inside Stripe's own payment fields and are sent directly to Stripe. They never reach our servers and we never store them.
7. Delivery
We dispatch within 2 business days of payment clearing, to the address you enter at checkout. Please check it: we cannot reroute a parcel once it is with the carrier, and a redelivery to a corrected address is charged again at the normal rate.

8. Retention of title
The cards remain our property until they have been paid for in full.
9. Right of withdrawal
If you are a consumer in the EU, you have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days from the day on which you, or a third party named by you who is not the carrier, take physical possession of the goods. Where an order is delivered in several parcels, it runs from the last one.
To exercise the right, tell us by a clear statement, for example an email to hey@drkpact.com, that you are withdrawing from the contract. Quoting your order number is enough to identify it; you do not have to explain yourself. Sending the notice before the period expires is sufficient.
Effects of withdrawal
We refund all payments received from you, including the standard delivery cost, without undue delay and no later than 14 days from the day we are informed. Where you chose a more expensive delivery option than our cheapest standard one, we refund the cheapest standard rate.
We refund using the same payment method you used, and you incur no fee for that. We may withhold the refund until we have received the goods back, or until you supply proof of return, whichever is earlier.
Send the goods back without undue delay and in any event no later than 14 days from the day you notify us. You bear the direct cost of returning the goods. You are liable for any loss in value only where it results from handling beyond what is necessary to establish the nature and condition of the cards.
10. Returns beyond the statutory right
As a voluntary addition, and without affecting anything above, we accept returns for 30 days from delivery where the cards come back unplayed and in their original sleeve. Return postage is yours and the refund covers the item price. This is a goodwill arrangement, not a statutory right.
11. Faults and warranty
Your statutory rights on defective goods apply in full: two years from delivery under German law. A defect means a printing, cutting, or material fault, not wear from play or sleeving, and not a colour difference within normal print tolerance.

12. Limited runs
Each design is produced in a run of 100 numbered copies. When a run is sold out it is retired and we do not reprint it. Stock counts shown on the site are updated as orders are paid; a card can sell out while it is sitting in your cart, and a cart does not reserve stock.
13. Newsletter
Signing up to the list is optional, has no effect on any order, and you can leave at any time using the link in any email we send. What we store and why is described in the privacy policy.
14. Liability
We are liable without limitation for injury to life, body, or health, for intent and gross negligence, and under the German Product Liability Act. For slight negligence we are liable only where a material contractual obligation is breached, and then only up to the damage typically foreseeable at the time the contract was concluded. Nothing in these terms limits liability that cannot lawfully be limited.
15. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.
16. Dispute resolution
The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. Our email address is at the top of this page.
We are not obliged to take part in dispute resolution proceedings before a consumer arbitration board, and we do not do so. We would rather you wrote to us first: most of what reaches an arbitration board is a problem that could have been fixed in one email.
17. If part of this is unenforceable
If any provision of these terms is or becomes invalid, the remainder stays in force.
